How Moody got the seat
It was Moody's quiet fealty to Ron DeSantis that led to his decision in January 2025 to appoint her to the Senate to replace Marco Rubio. She had earned that loyalty over six years as Florida Attorney General. She secured statewide victories in 2018 and 2022 for attorney general, so she is not an unknown quantity to Florida voters, but she has never faced them in a Senate race. DeSantis cited immigration toughness and her law and order record as reasons for the appointment, but he also pointed to her role in defeating the marijuana and abortion amendments on the 2024 ballot. That last piece matters because it wired her appointment directly to a political campaign outcome, which became the thread Nixon is pulling.
The controversies
The central one is the Hope Florida scandal. As Florida attorney general, Moody's office approved the diversion of $10 million of taxpayer money to the Hope Florida Foundation, and a series of legislative hearings in 2025 revealed that money was then routed into political action committees fighting Amendment 3. The grand jury report did not suggest Moody knew the funds would later be transferred to political organizations, so this is a contested allegation, not a finding of wrongdoing against her personally. But it prompted one Republican legislator to call it a criminal act, which gives Nixon bipartisan cover to keep pressing it.
Beyond that, critics point to her record as AG. Moody signed onto briefs defending voter suppression laws including Senate Bills 90 and 7050, and also defended a congressional map that plaintiffs argued discriminated against Black voters. She does few interviews outside conservative media like Fox News and has kept a low profile on most issues, which makes her harder to attack but also harder to know.
Can Nixon actually win?
The polling as of mid-September 2026 gives two very different reads, which is itself telling. A Florida Politics/St. Pete Polls survey published September 17 showed the race tied at 45% to 45%, with Nixon leading independents 50% to 37%. A Quantus Insights poll conducted September 8 to 10 told a different story: Moody leads Nixon 50% to 43%, and more than 90% of respondents who picked a candidate say they have definitely decided, which narrows the persuadable universe considerably. The RealClearPolling average as of mid-September has Moody up roughly 8.7 points.
The structural picture still favors Moody. Even in Jacksonville, Nixon's home turf, Moody leads 58% to 38%. That is a hard number for any campaign to overcome on its own ground.
What Nixon has is a genuine corruption narrative at a moment when appointed incumbents are inherently more vulnerable than elected ones. A political science professor at Florida Atlantic told Newsweek that Nixon has made corruption a major part of her campaign, and if she can turn the Hope Florida report into a steady drumbeat of bad headlines, it will hurt Moody more.
The race is closer than conventional wisdom predicted. That does not make Nixon the favorite. It makes her a real candidate in what was supposed to be a walkover, and there is a difference between those two things.
